The theory of punishment should be included in the analysis of the
state form, too. I have tried to call to attention to Rusche and
Kirchheimer and Pashukanis. David Garland has wonderful introductory
chapters on them in his Punishment and Social Theory. On Pashukanis,
Jeffrey Reiman's "The Marxian Critique of Criminal Justice" is
succinct, clearly argued, and profoundly insightful. The essay
originally appeared in Criminal Justice Ethics 1989 (Winter/Spring):
30-50 and was reprinted in Radical Philosophy of Law, ed. David S
Caudill and Steven Jay Gold (Humanities Press, 1995).
