Also worth a careful read is Robert Albritton's attempt to theorize
rechtsstaat on the basis of the fetishistic form of the legal
subject. I find very helpful indeed Albritton's elaboration of
Pashukanis in his A Japanese Reconstruction of Marxist Theory. Not
least because he goes on to show how nationalist ideology is almost
inherent in the rechtstaatlich form of human association. Albritton's
chapter on capitalist superstructure is a model of expository clarity.
