I do not want to refer back to the debates and problems we had. We must leave that behind. But just following the thoughts Howard put forward I think any major decission such as suspension should be made by the list rather than by an individual person or AC.

As much as I wish it were so, I have little hope we have finished the book on this. 
 
Also, as everyone realizes, however corrosive flames and bad feeling exchanged among us, episodes of the sort we go through also threaten the survival of the list, as you yourself acknowledged. 
 
In the interest of list survival, please give consideration to lessons amassed by long legal experience everywhere – it is not a wise idea to have anyone judge their own cause. 
 
I have no axe to grind and I make no judgments whatsoever about rights or wrongs. I simply observe from long history that you are often not a disinterested party when it comes to the disputes that have emerged. 
 
For that reason I think you should quickly recuse yourself in the future from any implementation of list policy that involves punitive action of the sort we have just seen. 
 
In fact the point might well be generalized. Independent of what or who the issue concerns, it might very well be a good idea that the person in the position of holding the list together -- as you do -- specifically not participate in matters of discipline concerning violations of list decorum. You might find that others could insist much more rigorously and consistently on conduct appropriate to the nature of our exchange. 
 
Let me add that I make no fetish of legality here – I have no doubt it would be preferable to think in terms of a lively policy of criticism self-criticism all round. But it seems clear the limited nature of our collaboration does not lend itself to the cohesion required for that.
