I would say 'yes' because it is  socially necessary labour and it is part of 
production.

'Guard labor' -- what I referred to  previously -- does not produce 
commodities
but rather protects their  ownership. From an individual capitalist 
perspective, 
they -- like lawyers -- may be deemed necessary, but they do not  themselves
produce commodities.

I agree with you on this. The point I was making by relying on Marx was  
thinking of an entirely new social framework of production. In other wors, I was  
refering to the potentialities which may be brought to acctuality if social  
relations were chnaged toward socialist forms of ownership.
