Victim Notification of Release


Issue: How many states provide for notification for victims of the pretrial release of defendants. (Ch.12, Sub. A-2. Note #5)

I found all states have adopted some kind of victim's bill of rights. I found the provisions in twenty-nine state constitutions. The remaining jurisdictions had adopted the measures through statutes. In addition, the majority of states (28) make provisions for notification of victims upon the defendant's pretrial release. The victim's written request is usually a prerequisite to notification. I found six states that made provisions for notification only for certain types of crimes. The remaining states usually had provisions for notification upon post-conviction release of defendants, but had not referred to pretrial release. Colorado required victims to be notified of release if they were believed to be in danger. CO- CO Rev. Stat. 24-4.1-303.
